Cap the compensation on medical mishaps

New Delhi, March 26,2018:

Compensation is consumers right for any medical mishap. To err is human and for that the government has provided the  indemnity insurance which every doctors takes before starting practice.

Medical profession is a social profession where the consultation charges are taken not on the basis of patient’s income.

Poor or rich gets the same subsidised consultation charges, said Dr KK Aggarwal Immediate Past National President IMA and President Heart Care Foundation of India, while adressing a gathering of thousands of doctors during the IMA Maha Panchayat held here in the city here today at Indira Gandhi Stadium.

Dr Aggarwal said there can be no two standards for the government and the medical profession. The compensation for tubectomy death is fixed at Rs 2 lac and also compensation, under Clinical Trial in Rule 122 DAB of Drugs and Cosmetics Rules, is fixed at Rs 2 lac for any death with expected mortality of 90 % or more within 30 days. The compensation in other cases varies from 4 lac to 47 lacs based on the health status of the patient.

The present formula of 70 – age of injury multiplied by the annual income of the patient plus 30% and minus 33% is not acceptable to the medical profession as it discriminates between the poor and the rich.

The government must accept the medical profession’s voice at the earliest in the interest of the society.
